Flarity – Terms of Use

  • Use at your own risk. Flarity helps you track IBD symptoms (Crohn's, Colitis, and Indeterminate IBD). It is not medical advice.
  • Always consult your doctor for diagnosis or treatment.
  • Your data is yours. You own what you log. We use it only to run and improve the app as described in our Privacy Policy.
  • Subscriptions auto renew unless you cancel in your Apple ID settings.
  • Ontario, Canada law applies. Disputes go to Ontario courts.
  • Apple is not responsible for the app.
  • We may terminate accounts if rules are broken.
  • The app is provided “as is” and “as available”.

Full Terms of Use

These Terms of Use (“Terms”) govern your use of the Flarity mobile application (the “App”) provided by Flarity (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

  • You must be at least 18 years old, or the age of majority in your jurisdiction, to use this App.
  • If you are under 18, you may use the App only with the involvement of a parent or legal guardian.

2. Health Disclaimer

  • Flarity is not a medical device and does not provide medical advice.
  • The App helps users track, log, and better understand symptoms related to inflammatory bowel disease (IBD), including Crohn's Disease, Ulcerative Colitis, and Indeterminate IBD.
  • The App is not a substitute for professional medical diagnosis, treatment, or advice.
  • Always consult your physician or qualified healthcare provider with questions about your health. Never disregard professional advice because of information in the App.

3. License to Use

  • We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by Apple’s App Store Terms of Service.
  • You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the App unless laws allow it or you have our written permission.

4. Acceptable Use

You agree not to:

  • Use the App for unlawful, harmful, or fraudulent purposes.
  • Upload or transmit viruses, malware, or other harmful code.
  • Attempt to gain unauthorized access to the App, its systems, or other users’ data.
  • Use automated tools to scrape or interfere with the App’s functions.

5. User Content

  • You retain ownership of the symptoms, notes, and other data you log (“User Content”).
  • By using the App, you grant us a limited license to process and store your User Content solely to provide and improve App features.
  • We do not sell your personal health data to third parties. See the Privacy Policy for details.

6. Data and Privacy

  • The App may integrate with Apple HealthKit to collect and display health information when you allow it.
  • Data accessed through HealthKit is used only to provide App features and is not shared with third parties without your explicit consent.
  • Our use of data is governed by the Flarity Privacy Policy, which is incorporated into these Terms.

7. Subscriptions and Payments

  • Some features may be offered via paid subscriptions or in-app purchases.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions auto renew unless canceled at least 24 hours before the end of the billing period.
  • Manage or cancel subscriptions in your Apple ID account settings.
  • Fees are non-refundable except where required by law.

8. Disclaimer of Warranties

  • The App is provided “as is” and “as available”, without warranties of any kind.
  • We do not guarantee the App will be uninterrupted, error free, secure, or free of harmful components.
  • We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

  • To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including data loss, health outcomes, or business interruption.
  • Our total liability arising out of or relating to these Terms or the App shall not exceed the amount you paid, if any, for use of the App in the past 12 months.

10. Termination

  • We may suspend or terminate your access to the App at any time if you violate these Terms.
  • You may stop using the App and delete it from your device at any time.

11. App Store Terms

  • These Terms are between you and Flarity, not Apple.
  • Apple is not responsible for the App or its content and has no obligation to provide maintenance, support, or warranty services for the App.
  • If there is a conflict between these Terms and Apple’s terms, Apple’s terms control.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of laws principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

13. Changes to These Terms

We may modify these Terms by posting an updated version on this page and updating the “Last Updated” date above. By continuing to use the App after changes take effect, you agree to the revised Terms. If you do not agree, you must stop using the App.
